Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using Dostily ("the Service", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. You must be at least 18 years old to use Dostily. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

2. Description of Service

Dostily is an AI companion platform operated by Dostily ("the Company"). You interact with AI-powered virtual friends through text chat and voice calls. AI friends are generated by artificial intelligence and are not real people. All conversations are with AI, not humans. The Service is provided on an "as is" and "as available" basis.

3. Account Responsibilities

• You are responsible for your account security and all activity under it.
• Provide accurate and complete information during registration.
• One account per person. Multiple accounts to bypass limits or bans is prohibited.
• You must not share your account credentials with any third party.
• Notify us immediately at hello@dostily.com if you suspect unauthorized access.

4. Acceptable Use

You agree NOT to use Dostily to:

• Generate sexually explicit, pornographic, or obscene content
• Promote violence, self-harm, suicide, or harm to others
• Harass, threaten, stalk, or bully any person
• Generate content involving minors inappropriately in any way
• Extract harmful, dangerous, or illegal instructions from the AI
• Use the service for any illegal purpose under any applicable jurisdiction
• Reverse-engineer, decompile, hack, or exploit the service or its infrastructure
• Use bots, scrapers, or automated tools to access the service
• Circumvent usage limits, subscription restrictions, or security measures
• Impersonate any person or entity, or misrepresent your affiliation
• Upload malware, viruses, or any malicious code
• Use the service to spam, phish, or distribute unsolicited communications

Violations may result in immediate account suspension or permanent ban without refund or prior notice.

5. AI Limitations, Disclaimers & No Professional Advice

By using Dostily, you acknowledge and agree that:

Nature of AI

• AI friends are computer programs powered by large language models (LLMs). They are not real people and do not have feelings, consciousness, emotions, or independent thoughts.
• AI responses are generated based on patterns in training data and may be inaccurate, misleading, incomplete, outdated, biased, or entirely fabricated ("hallucinations"). The AI does not "know" things — it generates plausible-sounding text.
• AI responses do not represent the views, opinions, or recommendations of Dostily or its operators.
• AI conversations are bounded by the model's training data and safety filters. Responses do not constitute expert knowledge on any subject.

No Professional Advice

• Dostily is not a substitute for professional mental health support, therapy, counseling, psychiatric treatment, or any form of medical care. If you are experiencing depression, anxiety, suicidal thoughts, or any mental health crisis, please contact a qualified professional or local emergency services immediately.
• Nothing said by an AI friend should be treated as financial advice, investment advice, legal advice, tax advice, medical advice, or professional guidance of any kind.
• Do not make financial decisions, health decisions, legal decisions, or any life-altering decisions based on AI-generated conversations. Always consult a qualified professional.
• If the AI provides any information that sounds like professional advice, it is not reliable and should not be acted upon.

Emotional Reliance

• Dostily is designed for entertainment, companionship, and casual conversation. It is not a replacement for real human relationships, professional therapy, or emotional support services.
• We strongly discourage excessive emotional dependence on AI companions. If you find yourself relying on AI conversations as your primary source of emotional support, we encourage you to seek help from friends, family, or a mental health professional.
• We are not responsible for any emotional distress, psychological impact, or adverse effects resulting from interactions with AI friends.

Assumption of Risk

• You use the service entirely at your own risk and discretion.
• You assume all risks associated with interacting with AI-generated content, including but not limited to receiving inaccurate information, emotional reactions to AI responses, and any actions you take based on AI interactions.

6. Subscriptions & Payments

• Paid plans are billed monthly through Stripe (Stripe, Inc.), our secure payment processor.
• You authorize recurring monthly charges until you cancel. Stripe automatically charges your saved payment method each billing cycle.
• Cancel anytime — access continues until the billing period ends.
• Prices are displayed in Indian Rupees (INR) or US Dollars (USD) based on your location. International users may see charges in their local currency based on their payment provider's exchange rate.
• We reserve the right to change prices with at least 30 days' prior notice. Continued use after the price change constitutes acceptance.
• Taxes (including GST, VAT, or sales tax) may apply depending on your jurisdiction and are your responsibility.

Payment Security

• All payments are processed by Stripe, a PCI DSS Level 1 certified payment processor — the highest level of security certification in the payments industry.
• Your card details are entered directly on Stripe's secure hosted checkout page (checkout.stripe.com). Your card number, CVV, and expiry date never touch our servers — not even temporarily.
• All payment data is encrypted using industry-standard TLS encryption in transit and AES-256 encryption at rest on Stripe's infrastructure.
• We only store Stripe reference IDs (customer ID and subscription ID) to manage your subscription. These IDs cannot be used to make charges without Stripe's authentication.

7. No Refunds

All payments are final and non-refundable, except where required by applicable law.

• No refunds for any reason including dissatisfaction, unused time, or accidental purchases.
• Accounts banned for policy violations are not entitled to refunds.
• Fraudulent chargebacks will result in permanent account termination and potential legal action.

For EU/EEA users: By subscribing, you expressly consent to immediate access to digital content and acknowledge that you waive your 14-day right of withdrawal once the service is accessed.

8. User-Generated Content

• You retain ownership of content you create (messages, friend configurations, uploaded images).
• You grant Dostily a non-exclusive, worldwide, royalty-free license to use, process, and store your content solely for the purpose of providing and improving the Service.
• You are solely responsible for the content you submit and represent that it does not violate any third-party rights or applicable laws.
• We reserve the right to remove any content that violates these Terms without notice.

9. Intellectual Property

• The Dostily name, logo, design, source code, algorithms, and technology are our intellectual property and are protected by copyright, trademark, and other applicable laws.
• AI-generated content is for your personal, non-commercial use only.
• You may not reproduce, distribute, modify, or create derivative works of our Service without prior written consent.

10. Account Termination

• You may delete your account anytime via Settings or by emailing hello@dostily.com.
• We may suspend or terminate accounts that violate these Terms, at our sole discretion, with or without notice.
• Upon deletion, all data is permanently removed within 30 days, except where retention is required by law.
• We reserve the right to discontinue the Service entirely with 30 days' notice to active subscribers.

11. Service Availability & Downtime

• We strive to keep Dostily available 24/7, but we do not guarantee 100% uptime.
• The service may be temporarily unavailable due to scheduled maintenance, server upgrades, infrastructure updates, or unforeseen technical issues.
• We may perform maintenance at any time, with or without prior notice.
• Third-party service outages (AI providers, voice services, payment processors) may temporarily affect functionality and are outside our control.
• No refunds, credits, or compensation will be issued for any downtime, service interruptions, degraded performance, or temporary unavailability of features.
• We are not liable for any loss of data, missed conversations, or disruption caused by service downtime.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
• We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or harmful components.
• We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Service.
• We are not liable for any loss or damage caused by reliance on AI-generated content, service outages, data loss, unauthorized access to your account, or actions of third parties.
• Our total aggregate liability for all claims shall not exceed the amount you paid to us in the 3 months preceding the event giving rise to the claim, or $50 USD (whichever is greater).
• Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability is limited to the fullest extent permitted by applicable law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Dostily, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit through the Service.

14. Dispute Resolution

We encourage you to contact us at hello@dostily.com to resolve any disputes informally before taking formal action.

• Informal Resolution: Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting us for at least 30 days.
• Arbitration: If informal resolution fails, any dispute shall be resolved through binding arbitration in accordance with the rules of the Indian Council of Arbitration, except where prohibited by your local law.
• Class Action Waiver: To the extent permitted by law, you agree that all claims will be brought in your individual capacity and not as part of any class action, collective action, or representative proceeding.
• Exceptions: Either party may seek injunctive relief in any competent court to protect intellectual property rights.

EU/EEA users: Nothing in this section limits your right to bring claims before the courts of your country of residence or to use the European Online Dispute Resolution platform (https://ec.europa.eu/odr).

15. International Users

• Dostily is operated from India. If you access the Service from outside India, you do so at your own initiative and are responsible for compliance with your local laws.
• You acknowledge that your data may be transferred to, stored, and processed in India and other countries where our service providers operate.
• If any provision of these Terms conflicts with mandatory consumer protection laws in your jurisdiction, that mandatory law shall prevail to the extent of the conflict.
• The Service is not intended for use in any jurisdiction where its use would be prohibited by law.

16. Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to causes beyond our reasonable control, including but not limited to: natural disasters, acts of God, war, terrorism, riots, pandemics, government actions, power failures, internet outages, third-party service failures, or any other force majeure event.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Subject to the arbitration clause above, the courts in Hyderabad, Telangana, India shall have exclusive jurisdiction.

This does not affect mandatory consumer protection rights available to you under the laws of your country of residence.

18. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Dostily.
• Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
• Waiver: Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.
• Assignment: You may not assign or transfer your rights under these Terms. We may assign our rights without restriction.
• Notices: We may send notices via email to the address on your account or by posting on the Service. You are responsible for keeping your email address current.

19. Changes to Terms

We may update these Terms at any time. Material changes will be notified at least 15 days in advance via email or in-app notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service and delete your account.
